Expatriation Allowance

Hi,

I am Spanish and I have been living in Belgium for over 7 months and I expect to be offered a position soon in the EU instituions. am I still elegible for the expatration allowance? I dont understand the official document statement for elegibility: "who during the five years ending six months before they entered the service did not habitually reside or carry on their main occupation within the European territory of that State. For the purposes of this provision, circumstances arising from work done for another State or for an international organisation shall not be taken into account" as I do not know whether it means I am only elegible if I have not lived in Belgium at any point during the last five years, or that for not being elegible I must have lived in Belgium ininterruptedly for the past 5 years.

The rule does not mean that you must avoid living in Belgium entirely over the past five years. Instead, it looks at whether Belgium was your habitual residence or the location of your main occupation during the majority of the reference period.

If you lived and worked outside Belgium for most of that five-year reference period and only moved to Belgium relatively recently (e.g., in the past 7 months), you may still qualify for the expatriation allowance, provided your main occupation or habitual residence during the bulk of that period was elsewhere.

To confirm your specific case, I recommend providing full details of your residence and employment history for the relevant period to the HR department of the institution offering you the position. They are best positioned to assess your eligibility.

Hi David, thank you so much for your quick response.

I am a bit consued now, I found this reply in this same forum here: Expatriation allowance: the regulations | EU Training.

From that reply I understand that, if let's say, I have been living in Belgium for 4 years and prior to that I lived in Spain, I would still get the expatration allowance.

However from your reply I understand that only if I lived a maximum of 2.5 years in Belgium out of the last 5, I would be elegible to get the expatriation allowance.

Do you know which one I am misunderstanding?
